Refutation of Preparing for Child Custody Cases
The following quote appeared in the Watchtower publication called Our Kingdom Ministry in Aug. 1992 vol 35.
“A packet of legal materials is available when publishers are involved in lawsuits over child custody and visitation. The
packet contains court decisions and other materials designed to assist an attorney who is representing a publisher whose
parental fitness is being challenged because of his or her religious beliefs or practices. The Society's Legal Department
should be contacted by the body of elders if (a) court papers or legal documents indicate that the publisher's religion
is going to be attacked; (b) apostate literature, a religious expert, or a former Witness will be used to testify against the
publisher; (c) a pretrial deposition of the publisher will be taken; or (d) a psychological examination or home study is
scheduled. The packet offers no assistance in cases involving secular issues such as support and property.” Our Kingdom Ministry in Aug. 1992 vol 35.
It was written by the Watchtower to inform Jehovah’s Witnesses that the booklet “Preparing for Child
Custody Cases” was available from the Society to help Jehovah’s Witnesses deal with Duane Magnani and the success he was experiencing in child custody cases against
Jehovah’s Witnesses
In this booklet Jehovah’s Witnesses are counseled to give testimony to the court
which is knowingly untrue. In 1988 Duane Magnani wrote the book, “Refutation of Preparing for Child Custody Cases”. In this book he thoroughly refutes the
arguments and materials presented by the Watchtower with full photocopy documentation.
The booklet, “Preparing for Child Custody Cases” advises Witnesses to
give testimony to the court which is knowingly false, It is this strategy that the Watchtower Society deems appropriate even calling it “Theocratic war strategy” in the
Watchtower magazine.
“There is one exception, however, that the
Christian must ever bear in mind. As a soldier of Christ he is in theocratic warfare and he must exercise added caution when dealing with Gods
foes. Thus the Scriptures show that for the purpose of protecting the interests of Gods cause, it is proper to hide the truth from Gods enemies.”

In the book, Aid to Bible Understanding Jehovah’s Witnesses are told that “a person is not under
obligation to divulge truthful information to people are not entitled to it”
“Lying generally involves saying something false to a person who is entitled to know the truth and doing
so with the intent to deceive or to injure him or another person... While malicious lying is definitely condemned in the Bible, this does not mean that a
person is under obligation to divulge truthful information to people who are not entitled to it.” Aid to Bible Understanding, 1971 ed., p. 1060- 1061
It becomes clear that the Society not only condones but even counsels
it’s members to lie, even in a court of law. How then can one trust the testimony of a Jehovah’s Witness in a court of law?
